Terms of Use

These Terms of Use set out the rules and conditions for using the Automarticles platform and should be read carefully by every user. By accessing, browsing or using any feature of the platform, the user declares that they are aware of, agree with and are bound by these provisions.

Use of the services is conditional on full acceptance of these Terms, and the user's agreement is considered implied by remaining on the platform.

Automarticles may only be used by people over 18 years of age with full legal capacity under Brazilian law. Users who do not meet these requirements, or who do not agree with any clause of this document, must not use the services offered.

Automarticles is a platform that plans, writes and publishes blog articles, to help companies and professionals show up on Google and in the answers of artificial intelligence tools. The platform is operated by AUTOMARTICLES SOLUÇÕES DIGITAIS LTDA., founded on October 16, 2023.

The platform's main features include:

• Content strategy: suggestions of keywords and of groups of articles that support each other, based on the business context provided by the user;
• Brand DNA: information about the company, its audience and its writing style, used to guide the content generated;
• AI article generation: creation of articles and the images that go with them, based on the information provided by the user;
• Autopilot: planning, writing and publishing articles at the pace chosen by the user;
• Hosted blog: a blog with the user's brand, hosted by Automarticles, which can use the user's own domain;
• Integrations: publishing to blog platforms (such as WordPress, Wix and Ghost, or others via Webhook), sharing on social networks (LinkedIn and Instagram) and reading data from Google Search Console and Google Analytics;
• Reports: tracking of indexing and traffic with Google data;
• Team management: adding other people to the account, with permissions set by the user.

A USER is any individual or legal entity that accesses or uses the services offered by the Automarticles platform. In particular, the platform's target audience consists of two main profiles:

(i) marketing professionals, including analysts, agencies and consultants; and (ii) business owners and professionals who want to produce content for their own blog or website on their own.

The processing of personal data carried out by Automarticles is described in the Privacy Notice, which should be read together with these Terms.

Automarticles is sold as a subscription. For new subscriptions, the only difference between the options is the number of articles per month: the features described in section 1 are available in all of them, subject to the limits on blogs and team members shown on the Pricing page and on the Subscription screen.

Monthly subscription

Annual subscription

The annual subscription has a 40% discount on the price of twelve monthly payments and is charged at once, at the start of each subscription year.

Promotions

Automarticles may offer limited-time promotions. As of this version, first-time subscribers pay the first month of the monthly plan with a 70% discount; this discount does not apply to the annual plan. A promotion applies only to the charge indicated and may be changed or ended at any time, with no effect on charges already made.

Custom domain and White label

Every plan lets the user connect their own domain to the hosted blog. White label is a separate feature, purchased separately: it removes the Automarticles brand from the footer of the hosted blog and unlocks features for agencies.

Earlier subscriptions

Users who subscribed to an earlier plan keep the price and conditions of their own subscription while it is active, including when undoing a scheduled cancellation or changing the number of articles. The table above applies to new subscriptions.

Platform usage is measured in credits. Each article generated uses 1 credit.

• With each paid charge, the subscription releases the credits for the period: on the monthly plan, the plan's number of articles; on the annual plan, twelve months' worth, at once.
• Credits do not expire and carry over from one period to the next.
• Users with an active subscription can buy one-off credit packs on the Subscription screen (as of this version, 30 articles for R$ 299, 100 articles for R$ 849 or 200 articles for R$ 1,499). A pack is paid once, and its credits do not expire either.
• Free trial credits can only be used while the trial is active.
• Refunds and payment disputes remove credits, as described in the Refunds and disputes section.

Automarticles offers an automated solution for generating and managing content, using artificial intelligence and technological resources. Because it is an automated system, the user should be aware of certain conditions and limitations inherent to how the tool works.

By using the platform, the user acknowledges that:

a) Article generation is limited to the credits available in the account, according to the plan purchased, the one-off packs bought or the free trial.

b) The number of words per generated article may vary according to the topic, the parameters entered by the user and the tool's technical criteria, with no commitment to a fixed number of words.

c) Generated content is produced automatically, which is why Automarticles does not assure its accuracy, truthfulness, originality or suitability for specific purposes. We always recommend reviewing and validating the material before publishing.

d) Article generation and other platform features may be temporarily limited in cases of maintenance, technical restrictions, system instability or high user demand, without giving the user any right to indemnity or compensation.

Payments are made by credit card and processed by Stripe. Automarticles does not store card details. Purchases and renewals are subject to approval by the issuer of the card used by the USER. Invoices and Brazilian tax receipts (notas fiscais) are available on the Subscription screen. Automarticles may, at its discretion, add new payment methods in the future by updating these Terms.

Service fees may be adjusted annually based on the positive variation of the IPCA (Brazil's consumer price index) accumulated over the 12 months before the month of the adjustment. Alternatively, the platform may adjust prices by notifying the customer at least 30 (thirty) days in advance, within the applicable legal limits.

Changes to the price table for new subscriptions do not change the price paid by existing subscribers.

When creating an account, the user can try the platform for free, for a limited time and with a limited number of articles, both shown on the platform itself. When the trial ends, because the time or the trial credits run out, the user has 24 hours to subscribe. Without a subscription, the blog hosted by Automarticles goes offline, and the articles remain stored in the account.

When purchasing an Automarticles plan, the user gets immediate access to the platform's features and can use resources such as article generation, images, integrations and the other features offered.

It is important to note that the right of withdrawal is not the same as the free trial. The law provides for the right of withdrawal as protection against impulse purchases or mistakes, not as a way to use the service experimentally, which is the purpose of the free trial.

We therefore recommend that, before purchasing, the user tries the free trial and clears up any questions about how the platform works. Our team is available to provide any clarification needed.

Automarticles reserves the right, at its sole discretion, to suspend or end the user's access to the platform, and to delete their account, at any time, in the following situations:

• breach of these Terms of Use or of any platform policy;
• conduct that may constitute fraud, scams, or improper or illegal use of the services;
• use of the platform for unlawful purposes or purposes incompatible with what it is for;
• acts that may compromise the security, integrity or operation of the platform;
• providing false, incorrect or misleading information;
• abuse or excessive use of the services in a way that harms other users' experience;
• failure to meet legal or contractual obligations;
• acts that violate third-party rights, applicable rules, ethical principles or recognized social values.

Automarticles may take these measures without prior notice, especially in cases involving risk, bad faith, attempted fraud or harm to third parties or to the platform itself.

If the account is closed for breach of these Terms, the user will not be entitled to any refund of amounts paid and remains subject to the applicable legal measures, including compensation for damages.

Automarticles subscriptions are monthly or annual, with recurring billing.

When the user purchases a plan and registers a credit card, the corresponding amount is charged automatically at the end of each period, monthly or annual, until the services are interrupted, either by the user's cancellation or by unilateral termination at the platform's discretion, as set out in these Terms of Use.

If the user does not want to renew the subscription, they must cancel it before the next billing date, on the platform's Subscription screen or through Automarticles' official support channels.

The user can change the number of articles in the subscription on the Subscription screen. When increasing it, the prorated amount for the rest of the period is charged right away and the additional credits are released right away. A decrease takes effect right away, with no refund, and the lower price and credits apply from the next charge.

We recommend cancelling in advance to avoid a new charge.

The USER may cancel their subscription at any time on the platform's Subscription screen or by sending an express request to Automarticles support.

Cancellation does not return amounts already paid.

When a payment made through the current platform (for a subscription or a one-off pack) is refunded, in full or in part, or disputed with the card issuer, the unused credits generated by that payment are removed from the account, in proportion to the amount refunded or disputed. Credits already used are not removed, and credits from other payments are not affected.

If the dispute is closed in Automarticles' favor, the credits become valid again, minus the part that was actually refunded.

By using the platform, regardless of whether any service has been purchased, the user agrees to:

a) Use the platform ethically, lawfully and in accordance with these Terms of Use, current legislation and the principles of good faith.

b) Be solely and exclusively responsible for all content generated, published or shared through the platform, fully assuming the legal, civil and/or criminal consequences, including with regard to copyright, intellectual property, image, honor, privacy and other third-party rights.

c) Not use the platform for unlawful, fraudulent, misleading, abusive or offensive purposes, or purposes that violate the rights of third parties or of Automarticles itself.

d) Keep their registration data correct, up to date and truthful, being responsible for the accuracy of the information provided.

e) Not share access to their account with third parties, being responsible for any improper or unauthorized use resulting from sharing their login and password. To give other people access, the user must use the platform's team management.

f) Not attempt to improperly access, manipulate or interfere with the platform's code, operation, structure or security.

g) Respect the limits of the plan purchased, such as credits, connected blogs and team members.

h) Take full responsibility for any loss, damage or consequence resulting from improper use of the platform or breach of these Terms, including any complaints, notices, lawsuits or claims by third parties.

Automarticles undertakes to provide the services purchased with diligence and transparency, observing the following commitments:

a) Make available, according to the conditions and plans advertised, the features described in these Terms of Use, seeking to keep access to the platform regular and continuous.

b) Maintain the integrity, security and confidentiality of user data, in accordance with the General Data Protection Law (LGPD) and other applicable legislation.

c) Provide technical support and customer service, offering communication channels to answer questions, solve problems and give guidance on using the services.

d) Carry out updates and maintenance on the platform to improve the services and fix any failures, notifying users in advance of scheduled interruptions whenever possible.

e) Provide clear and accurate information about the services, plans, deadlines, costs, cancellation procedures and other contractual conditions, contributing to transparency in commercial relationships.

f) Make every effort to fix, quickly and effectively, any failures that may impair the operation of the platform, minimizing the impact on users.

The obligations above do not extend to situations beyond Automarticles' control, such as problems caused by third parties, unavailability of external services or force majeure events.

The PLATFORM will NOT, under any circumstances, be held liable for direct, indirect, incidental, consequential or any other damages arising from the use of, or inability to use, the tool, including but not limited to:

a) Automarticles is provided “as is”, with no promise, express or implied, of continuous availability, absence of errors, fitness for a particular purpose or specific results from its use, including positions on Google, indexing, traffic or citations in artificial intelligence tools.

b) The PLATFORM is not responsible for the content generated automatically by the tool, nor for decisions, strategies, publications, actions or omissions taken by users based on that content; analyzing, reviewing, validating and using the generated material is the user's sole responsibility.

Automarticles provides a support channel to help users with questions, technical difficulties or guidance on using the platform.

Support is provided during business hours (Brazil time) through the support chat inside the platform or at +55 83 99103-8232.

The response time is 1 (one) business day, but it may vary with the complexity of the request, with priority given to issues that directly affect how the tool works.

Automarticles is not responsible for failures resulting from improper use, external integrations or technical limitations outside its infrastructure.

Automarticles adopts appropriate technical and organizational measures to protect the security, confidentiality and integrity of the data entered on the platform, following practices aligned with industry cybersecurity standards. The platform is hosted by Vercel, with its database and authentication on Supabase (in the São Paulo region, Brazil) and image and file storage on Cloudflare. During the migration from the previous platform, part of the operation still runs on Bubble, which uses Amazon AWS infrastructure. Payments are processed by Stripe. The full list of providers is in the Privacy Notice.

The platform may include integrations with third-party services, such as:

• WordPress, Wix and Ghost, for publishing content directly;
• Webhook, for connecting to other blog management platforms;
• Google Search Console and Google Analytics, for indexing and traffic data about the user's blog;
• LinkedIn and Instagram, for posts promoting the blog.

The USER acknowledges and agrees that, when using these integrations, they may be redirected or connected to external environments whose terms of use and privacy policies are not controlled by Automarticles. In such cases, responsibility for the use of information and for security in third-party services lies with the respective providers of those solutions.

Automarticles is not responsible for failures, unavailability, leaks or other damages resulting from integrations or external services connected at the user's initiative, even through features made available on the platform itself.

Ownership of all intellectual property rights related to the Automarticles platform, including but not limited to its source code, features, design, brand, logo, institutional texts, plugins and other technical or visual elements, belongs exclusively to Automarticles and is protected by applicable law.

Accessing and using the platform does not grant the user any ownership right or license over those assets, except where expressly authorized by these Terms of Use or by any agreement signed between the parties.

On the other hand, all content created by the user through regular use of the platform, such as blog texts, AI-generated materials and other creations entered or exported, is the exclusive property of the user, subject to any copyright and third-party rights involved. Automarticles does not claim ownership of this content and may not use it for commercial purposes without the user's authorization.

The user agrees not to use the platform to produce or share content that infringes copyright, trademarks, trade secrets or other third-party rights.

If there is a suspected violation of copyright, trademark or any other intellectual property right, whether by the platform or by other users, the right holder may submit a report through Automarticles' official contact channels. The report will be reviewed seriously and, where appropriate, the necessary steps will be taken to remove the content or suspend access, in accordance with applicable law.

Automarticles reserves the right to change the content of these Terms of Use at any time, to improve them and to adapt them to new legal requirements, platform improvements or changes to its features.

Updated versions of the Terms will be published on this same page, showing the date of the last change. By continuing to use the platform after any changes are published, the user agrees to the new terms in force.

We therefore recommend reading these Terms periodically so the user is always aware of their rights and obligations when using the platform.
